Brain Games by Clever Branch terms of use
Last updated: October 21, 2026
These terms cover your use of Brain Games by Clever Branch (the "app"), made by Simple Tree LLC ("Simple Tree", "we"), an independent app studio in New York. By downloading or using the app, you agree to these terms.
Apple's Licensed Application End User License Agreement also applies if you got the app from the App Store, and the Google Play Terms of Service apply if you got it from Google Play. Where these terms and the store's terms differ about the store itself, the store's terms apply.
1. What the app is
Brain Games by Clever Branch is a puzzle game for entertainment: a short daily set of memory, reasoning and word puzzles, plus more games to play any time. It is not a medical device and does not diagnose, treat or prevent any condition. For health questions, talk to a doctor.
2. Who can use it
The app is made for adults and is open to everyone. It is not directed to children. If you are under 18, use the app with your parent or guardian's permission.
3. Free play and Premium
Each day's three puzzles ("Today's 3") are free for everyone, with no account and no ads. Brain Games Premium is an optional subscription that unlocks every game on any day, replaying any game as often as you like, and the archive of past days.
- Plans: an annual plan at $39.99 per year and a monthly plan at $9.99 per month, in US dollars. Prices in other countries are set by the App Store or Google Play and shown before you buy.
- Free trial: new subscribers to the annual plan may get a 7-day free trial. If you don't cancel before the trial ends, the annual price is charged when the trial ends.
- Trial reminder: if you allow notifications, the app reminds you on day 4 of the trial, at least 3 days before you are charged, with the date billing starts.
- Automatic renewal: your subscription renews automatically at the end of each period at the then-current price unless you cancel before it renews (on the App Store, at least 24 hours before the period ends). Payment is charged to your Apple Account or your Google Play account.
- Cancelling: on iPhone or iPad, turn off auto-renewal in Settings › [your name] › Subscriptions › Brain Games by Clever Branch › Cancel Subscription. On Android, open the Play Store, tap your profile picture, then Payments and subscriptions › Subscriptions › Brain Games Premium › Cancel subscription. The app's Settings screen has a "Manage subscription" link that opens the same page. After you cancel, Premium stays active until the end of the period you paid for.
- Refunds: Apple or Google handles all payments and refunds, and we cannot issue them directly. You can request a refund from Apple at reportaproblem.apple.com, or from Google Play through your Play Store order history.
- Price changes: if a price changes, Apple or Google will tell you in advance and, where required, ask for your consent before you are charged the new price.
- Family Sharing: Premium can be shared with your Family Sharing group.
4. Your data
Your progress is stored on your device and in your own backup (your private iCloud on iPhone and iPad, your Google backup on Android). It is never sent to us. See the privacy policy for details.
5. Our content
The puzzles, explanations, artwork, sounds and code in the app belong to Simple Tree or its licensors. We give you a personal, non-transferable license to use the app for your own non-commercial entertainment. You may share your daily result card. Please don't copy, resell or republish the puzzles.
6. Fair use of the app
Don't try to break, reverse-engineer or overload the app. Don't use it to break the law.
7. Changes
We may update the app, add or retire games, and update these terms. If a change to these terms matters to you, we'll show a notice in the app before it takes effect. If you keep using the app after that, the updated terms apply.
8. Disclaimers and limits
The app is provided "as is". We work hard to make the puzzles correct and the app reliable, but we can't promise that it will always be available or error-free. To the extent the law allows, Simple Tree is not liable for indirect or consequential damages. Our total liability for any claim about the app is limited to the amount you paid for Premium in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you, and nothing here limits rights you have under consumer protection law.
9. Law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, except where the law where you live requires otherwise.
10. Contact
Questions or problems can go through the support page. Choose "Something else" on the form and mention Brain Games by Clever Branch.
